Terms and Conditions of the Brooder369 Platform

Content Management:

The management of the Brooder369 platform reserves the right to delete and/or hide any offers and/or projects that violate the platform's terms, or that may cause direct or indirect harm to the platform or its users.

Disclaimer of Legal Liability:

• While the management of Brooder369 will take necessary care to protect the platform, subscriber information, and the data of clients and freelancers, users access the platform at their own risk. By doing so, users acknowledge that they are aware of all risks associated with accessing the platform, including but not limited to risks of unauthorized access, third-party interference, or other security vulnerabilities.

• Users are solely responsible for the use of the services offered on the platform and for any advice or information obtained—verbally or in writing—through the platform, unless explicitly stated otherwise in these terms or required by law.
• The services and information offered through Brooder369 are made available to any user of the platform. By accessing the platform, the user agrees to be bound by these terms and conditions, which form a legally binding agreement between the platform and the user.   • Fraud, deception, or misrepresentation resulting from a user's act, omission, or negligence.
  • Errors or misuse of the platform, or any inability to use or understand its content.
  • Losses due to delays in internet connectivity, platform suspension, or communication failures, including server downtime, maintenance, or inaccessibility—while Brooder369 remains responsible for providing technical support and resolving issues.
  • Losses resulting from actions by any governmental authority or any event beyond the control of the Brooder369 management.
• Users acknowledge that they are solely responsible for any information they submit to the platform and/or to other users. The management of Brooder369 and its affiliates disclaim all liability, to the fullest extent permitted by law, for any losses, damages, expenses, or costs incurred by users or third parties as a result of using—or being unable to use—the platform.
• These Terms of Use, their subject matter, and formation are governed by the laws and regulations of the Kingdom of Saudi Arabia (including non-contractual disputes or claims). Both parties agree that the courts of the Kingdom of Saudi Arabia shall have exclusive jurisdiction over such matters.
• The platform's role is limited to technical mediation between service providers and seekers; therefore, it is not responsible for user-generated content, but is responsible for managing financial transactions and providing fair mediation in disputes.

Registration on the Platform:

• Some parts of the platform are accessible only to registered users who provide required information.
• Users must register with accurate and complete information. Any false or misleading data may lead to account suspension, and the user bears full responsibility for any inaccurate information provided.
• Users must not attempt to register or log in under another person's name.
• Users are responsible for maintaining the confidentiality of their login credentials.
• The registration of a service provider account requires prior approval by the platform's management to verify the accuracy of submitted information.
• Each user is permitted to have only one account. If a problem arises, the user must contact support for resolution.
• By registering, the user confirms that they are 18 years of age or older. The platform may request proof of age when necessary.

Account Suspension or Termination for Violations:

Brooder369 reserves the right to suspend or permanently terminate any account that violates platform terms or causes harm to the platform or its users—without prior notice or consultation. This decision lies solely at the discretion of the platform's management.
The platform or any third-party authority may also withhold certain features or services in cases of violation, including but not limited to:

• Using stolen or unauthorized payment methods.
• Service seekers showing lack of seriousness (e.g., requesting services but not proceeding with orders).
• Acting as an intermediary by accepting a service request and then outsourcing it to another person (in such cases, the intermediary's account will be suspended and payments withheld).
• Causing harm to another user or to the platform.
• Engaging in communication outside the platform.
• Service providers failing to follow up on projects without a valid reason.
• Publishing work not created by the provider.
• Impersonating another user on the platform.
• Creating multiple accounts for any purpose.
• Posting fake or deceptive services.

User Obligations:

• Accurately and clearly describe their services.
• Deliver services within the agreed time and with the required quality.
• Refrain from offering services that violate Saudi laws, intellectual property rights, or public morals.

• Pay for services using the approved payment methods.
• Refrain from misusing services or using them for illegal purposes.

Intellectual Property:

• All content on the Brooder369 platform is protected under the Intellectual Property Rights Law and related regulations. This applies to content originating from the platform, its staff, or registered members. Users are prohibited from infringing upon these rights in any form.
• By registering, users expressly and implicitly agree to respect all copyright notices displayed on the platform.
• All rights related to the platform—including designs, trademarks, and software—are owned by Brooder369.
• Users may view, print, download, or temporarily store Brooder369 content for personal, non-commercial reference only, without modification, addition, or deletion. Users may not reproduce, redistribute, broadcast, publish, or commercially exploit any content, and no intellectual property rights are transferred through content downloads or use.
• By submitting content to Brooder369, you acknowledge yourself as its creator and grant Brooder369 the right to use, reproduce, modify, adapt, publish, translate, and create derivative works from your content for public use. You also waive your moral rights, including the right to object to modifications.
